If you are using the Website on behalf of a club, company or other organisation, you confirm that you are authorised to bind it to these Terms.

2. Who We Are and What We Do

Football Supporter Africa works with African football clubs, supporters’ groups and associations to develop sustainable, community-owned football. We are a not-for-profit organisation and reinvest our revenues in our activities. Through the Website we provide information about our work, supporter membership schemes, news and stories, and ways to get involved, donate and partner with us.

Our member clubs and supporters’ groups are separate organisations. Unless we say otherwise, we do not control their day-to-day operations and are not responsible for their acts or omissions.

3. Using the Website

You may use the Website for lawful purposes only and in line with these Terms. You agree that you will not:

  • break any applicable law or regulation;
  • use the Website in a way that is fraudulent, misleading or harmful;
  • attempt to gain unauthorised access to the Website, our servers or any connected systems;
  • introduce viruses, malware or other harmful code;
  • scrape, copy or harvest data from the Website by automated means without our written permission;
  • interfere with or disrupt the operation or security of the Website;
  • impersonate any person or organisation, or misrepresent your connection with us or any club; or
  • use the Website to send unsolicited advertising or spam.

We may suspend or restrict access to the Website at any time, for example for maintenance, security or legal reasons. We do not guarantee that the Website will always be available or free from errors.

4. Supporter Membership

4.1 What membership is

You can become an associate member of one of our member clubs or supporters’ groups by completing the sign-up process and paying any applicable fee. Membership packages and benefits (for example, an e-certificate, a listing in a club register, wristbands, certificates or a club shirt) are described on the Website and may change from time to time.

4.2 Membership is not an investment

Associate membership is a way of showing and giving support. It is not a share, security, loan or investment, and it does not entitle you to dividends, profit, repayment or any financial return.

4.3 Your details

You must give accurate information when you join and keep it up to date. You are responsible for any activity under your membership.

4.4 How membership fees are used

Fees are used as described on the Website. At the time of writing, 10% of each annual fee supports the development of our online platform, and the remainder, less the cost of any contents and delivery, goes to the club you are supporting. Clubs use funds for infrastructure and community projects in line with their objects.

4.5 Duration and renewal

Memberships run for 12 months from the date of purchase and renew automatically.

4.6 Ending membership

You may stop being a member at any time by contacting us. We may suspend or end your membership if you break these Terms, act in a way that harms our reputation or that of a club, or if the law requires. Refunds are covered in section 6.

5. Ordering Merchandise and Membership Packages

5.1 Placing an order

When you place an order, you are making an offer to buy. A contract is formed when we send you an order confirmation. We may decline an order, for example because an item is unavailable, a price is incorrect, or we suspect fraud. If we decline after you have paid, we will refund you.

5.2 Prices and payment

Prices are shown in [currency] and include or exclude VAT or other taxes as stated at checkout. Payment is taken through third-party payment providers. We do not store your full card details. Delivery charges, if any, are shown before you pay.

5.3 Delivery

We aim to dispatch items within 14 days of your order, but delivery times are estimates only. International shipping may be subject to customs duties, taxes and delays, which are your responsibility unless we say otherwise. Risk in the goods passes to you when they are delivered.

6. Cancellations, Returns and Refunds

6.1 Consumers in the UK and EU

If you are a consumer, you generally have the right to cancel an order for goods within 14 days of receiving them, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, email us at info@footballsupportersafrica.com with your order details. You must return the goods to us promptly (within 14 days of telling us you wish to cancel) in resalable condition, and you may have to pay the return costs. We will refund you within 14 days of receiving the goods back.

This right does not apply to items made to your specification or clearly personalised (for example, a shirt printed with your name), or to digital content once you have agreed it can be supplied immediately.

6.2 Faulty or incorrect items

If an item is faulty, damaged or not as described, contact us as soon as possible. Your statutory rights under the Consumer Rights Act 2015 are not affected, and we will offer a repair, replacement or refund as the law requires.

6.3 Other customers

For customers outside the UK and EU, we will handle refunds fairly and in line with the consumer laws of your country where they apply.

7. Donations and Fundraising

If you donate to us or to a club through the Website:

  • donations are voluntary and, once made, are non-refundable except where required by law or where we have made an error;
  • we will use donations for the purpose described when you give. If we cannot use a donation for that purpose, we will use it for a similar purpose within our objects, and we will contact you where practical;
  • a donation does not give you any ownership, voting rights, benefits or return, unless we state otherwise in writing; and
  • we are not a registered charity unless we state it.

We will comply with the laws and fundraising codes that apply to us.

8. Consultancy and Club Development Services

Information on the Website about our consultancy, club development, infrastructure and research services is for general information only. It is not professional, legal, financial or regulatory advice, and you should not rely on it as such.

Any consultancy engagement will be governed by a separate written agreement that sets out the scope, fees and terms. If there is a conflict between that agreement and these Terms, the separate agreement prevails for that engagement.

We do not hold an economic interest in the clubs we work with, and our network members have no involvement in our consultancy services. We take steps to avoid conflicts of interest and will tell you if we think one exists.

9. Intellectual Property

The Website and its contents, including text, graphics, logos, images, videos, research reports, the names “Football Supporter Africa” and “Sandlanders”, and their layout and design, are owned by us or our licensors and are protected by copyright, trade mark and other intellectual property laws. All rights are reserved.

You may view, print and share content from the Website for your personal, non-commercial use, as long as you keep any copyright notices and credit us as the source. You must not copy, modify, distribute, sell or commercially exploit any content without our written permission.

Our published research and reports may carry their own licence terms. Please check the document itself.

10. Content You Submit

When you send us content (such as comments, testimonials, photos, videos or stories), you confirm that you own it or have permission to share it, and that it does not break any law or anyone else’s rights.

You keep ownership of your content. You give us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit for length and format, and publish it on the Website, social channels and in our reports and promotional materials, for as long as you do not withdraw it. You can ask us to remove your content at any time, and we will do so within a reasonable time, but we cannot withdraw material already printed or distributed.

We may remove any content that is unlawful, offensive, discriminatory, misleading, infringing or otherwise breaches these Terms. Comments on news items and social channels must be respectful. We do not tolerate hate speech, harassment or abuse.

11. Photography and Video

We may photograph and film at events, club visits and tournaments. We will tell attendees in advance where practical and respect any reasonable request not to be photographed. For anyone under 18, we will obtain parent or guardian consent before publishing identifiable images. See our Privacy Policy for details.

12. Third-Party Links and Content

The Website may contain links to, or embedded content from, third parties (such as YouTube, Facebook and X) and our member clubs’ own sites. We do not control or endorse them, and we are not responsible for their content, availability or privacy practices. Your use of them is at your own risk and subject to their terms.

13. Visiting Our Clubs

We will try to arrange visits to member clubs when you ask us in advance. Visits are subject to the club’s availability and rules, local laws and safety conditions. You are responsible for your own travel, accommodation, insurance, visas, health and safety. We cannot guarantee the safety of any location or event, and you attend at your own risk.

14. Disclaimers

The Website and its content are provided “as is” and “as available”. To the fullest extent the law allows, we do not give any warranty that:

  • the Website will be uninterrupted, secure or error-free;
  • information on the Website is complete, accurate or up to date; or
  • any club or project will achieve particular results, such as promotion, funding or completion dates.

Statements about our plans, expected revenues and future activities are intentions only and may change.

15. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, your statutory rights are not affected.

Subject to that, and to the fullest extent permitted by law:

  • we are not liable for any loss that was not a reasonably foreseeable result of our breach, or for indirect or consequential loss;
  • we are not liable for loss of profit, revenue, business, data, goodwill or opportunity, if you use the Website for business purposes;
  • we are not liable for loss caused by events beyond our reasonable control (see section 17); and
  • our total liability to you for any claim connected with the Website or these Terms is limited to the greater of [the amount you paid us in the 12 months before the claim / 100]].

16. Indemnity

If you are a business or organisation, you agree to cover our reasonable losses, costs and claims arising from your breach of these Terms or your misuse of the Website. This section does not apply to consumers.

17. Events Beyond Our Control

We are not responsible for any delay or failure to perform our obligations caused by events outside our reasonable control, including natural disasters, public health emergencies, war, civil unrest, strikes, power or internet failures, changes in law, travel restrictions, banking or payment disruptions, and match or event cancellations. We will tell you and do what we reasonably can to reduce the impact.

18. Privacy and Data Protection

We handle your personal data as set out in our Privacy Policy [link]. By using the Website, you acknowledge that policy.

19. Changes to the Website and These Terms

We may update the Website, our services, membership packages and prices at any time. We may also update these Terms from time to time, for example because the law or our activities change. We will post the new version here with a new “Last updated” date and, for significant changes, give you reasonable notice. Continuing to use the Website after changes take effect means you accept them. Orders already placed are governed by the Terms in force when you placed them.

20. General

  • Entire agreement: these Terms, together with the documents referred to in them, are the whole agreement between us on this subject.
  • Severability: if any part of these Terms is found unenforceable, the rest remains in force.
  • No waiver: if we do not enforce a right straight away, that does not mean we have given it up.
  • Assignment: we may transfer our rights and obligations under these Terms to another organisation if we reorganise, and will tell you. You may not transfer yours without our written consent.
  • Third-party rights: a person who is not a party to these Terms has no right to enforce them, except as stated.
  • Notices: we may contact you by email or through the Website. You can contact us at the details in section 1.

21. Governing Law and Disputes

These Terms, and any dispute or claim arising out of or connected with them or the Website, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, but if you are a consumer living elsewhere, you may also have the right to bring a claim in your home country under its mandatory consumer laws.

If you have a complaint, please contact us first at info@footballsupportersafrica.com and we will try to resolve it within 14 days.
